1. Digital products only
All products sold by Bon Arte Photography are supplied digitally. We do not sell or ship physical products.
Our consumer products are:
- Self-Printable Wall Art
- Samsung The Frame Backgrounds
Our photography licences for book covers, music album and single artwork, Spotify artwork and other commercial uses are supplied exclusively on a B2B basis, as clearly stated on the relevant product page.
This Policy distinguishes between consumer purchases and B2B transactions.
2. Consumer digital products
Our Self-Printable Wall Art and Samsung The Frame Backgrounds are digital downloadable products.
Because these products are supplied digitally and are intended to be available for download immediately after purchase, we do not offer voluntary returns or refunds simply because you have changed your mind, no longer want the product or have purchased it in error.
This does not affect any statutory consumer rights that cannot legally be excluded.
3. Loss of the 14-day cancellation right
Where you purchase a digital product as a consumer, you will be asked before the download begins to:
- expressly request or agree that supply of the digital content begins immediately; and
- acknowledge that, once supply begins, you lose your statutory 14-day right to cancel the contract.
Where the required consent and acknowledgement have been obtained before supply begins, the statutory cancellation right does not apply once the digital content has been supplied.
If the required consent has not been obtained, your statutory cancellation rights will not be excluded by this Policy. UK rules require express consent and acknowledgement for immediate supply of digital content where the consumer is to lose the 14-day cancellation right.
4. Faulty or defective digital products
Our no-refund policy does not apply where digital content does not conform to the contract.
If a downloaded file is:
- technically corrupted;
- defective;
- materially different from its description (wrong item provided); or
- otherwise not of the standard required by applicable consumer law,
please contact us at:
We will first seek to repair the file or provide a replacement, where this is possible and appropriate.
For example, if a file is corrupted or cannot be opened correctly, we will normally provide a replacement file.
If repair or replacement is impossible, disproportionate, or cannot be provided within a reasonable time and without significant inconvenience, you may have a statutory right to an appropriate price reduction or refund under applicable consumer law.
5. How to report a faulty file
Please contact us as soon as reasonably possible and provide:
- your name;
- order number;
- the product purchased; and
- a description of the problem.
Where helpful, we may ask you to provide a screenshot or other information showing the technical problem.
We will investigate the issue and, where appropriate, provide a replacement or repaired file.
6. B2B photography licences
Our commercial photography licences are sold exclusively on a B2B basis.
This includes:
- book-cover licences;
- music album and single artwork licences;
- Spotify artwork licences; and
- other commercial photography licences identified as B2B on the relevant product page.
These transactions are not offered to consumers.
B2B licence purchases are therefore not subject to consumer cancellation rights applicable to consumer contracts.
Unless otherwise expressly agreed in writing, B2B licence purchases are non-refundable once the licence has been purchased and supplied.
A refund will only be considered where:
- Bon Arte Photography has failed to supply the purchased licence;
- the supplied licence materially fails to correspond with the licence expressly purchased; or
- a refund is otherwise required by the applicable contract or law.
The relevant licence agreement and product terms apply to each B2B licence purchase.
7. Refund method and timing
Where a refund is legally due, it will normally be made using the same payment method used for the original transaction, unless another method is agreed or required by law.
Where a statutory refund is due under applicable consumer law, it will be provided within the applicable statutory timeframe. Under the Consumer Rights Act 2015, refunds arising from the statutory remedies for defective digital content must be made without undue delay and, in the relevant circumstances, within 14 days of the trader agreeing that the consumer is entitled to the refund.
8. Your statutory rights
Nothing in this Policy excludes or restricts any consumer rights or other legal rights that cannot lawfully be excluded or restricted.
If a digital product does not conform to the statutory requirements applicable to digital content, the remedies provided by applicable law remain available.
